Same-sex marriage can bring complications involving same-sex divorce, including handling child custody, support, property division and other issues. These same issues can arise for unmarried couples and nontraditional families. Support may be granted based on the length of the relationship. However, the relationship may have begun long before a recognized wedding or a formal ceremony may ever have taken place.


Establishing the length of the relationship, for purposes of obtaining support, may be complicated. However, current alimony provisions in Massachusetts allow courts to calculate the length of the marriage by including the length of time the couple lived together. This means that if you were married only two years ago, but lived as though you were married for 20 years before that, your alimony may be based on a 22-year marriage.
