A Prenuptial Agreement, often simply known as a "Prenup," is created before you are married. Both can be effective in outlining your financial situation and your wishes for the future. Generally, an Agreement will be upheld providing that the Agreement you reach is fair and reasonable today and at the time of your divorce. For example, Massachusetts enacted the Alimony Reform Act of 2011, which significantly changed the alimony laws in our state. Lifelong alimony is no longer possible for those who have been married less than 20 years and there are limitations as to the duration and amount of alimony available. Further, the alimony laws in New Hampshire changed on January 1, 2019.
